Terms of Service

These Terms of Service (“Terms”) govern access to and use of the BOOQDAT ticketing platform operated by BOOQDAT USA LLC (“BOOQDAT,” “we,” “us,” or “our”). By using our platform, you agree to these Terms.
1. Platform services
BOOQDAT provides tools for event promoters to publish events and sell tickets, and for attendees to purchase and manage digital tickets. We may update platform features from time to time.
2. Promoter obligations
Promoters are responsible for accurate event listings, lawful event operations, honoring ticket commitments, and compliance with applicable local, state, and federal requirements. BOOQDAT may remove events that violate policy or law.
3. Ticket purchases
Ticket buyers must provide accurate checkout information. Completed purchases are subject to event-specific rules and the BOOQDAT Refund Policy where applicable. Fraudulent transactions may be canceled or reversed.
4. Fees and payments
Platform service fees, payment processing fees, and any promoter-defined charges are displayed during event setup or checkout. By using the platform, you authorize charges applicable to your transaction.
5. Cancellations and changes
Promoters are responsible for communicating event cancellations, postponements, or significant changes. BOOQDAT may assist with notices and transaction logs but is not the event organizer unless explicitly stated.
6. Acceptable use
You agree not to misuse the platform, attempt unauthorized access, interfere with service operations, or use BOOQDAT for unlawful activity. Violations may result in account suspension or termination.
7. Intellectual property
BOOQDAT branding, software, and platform content are owned by BOOQDAT USA LLC or its licensors. Users retain ownership of promoter-uploaded content but grant BOOQDAT a license to display and distribute it for platform operations.
8. Disclaimers and limitation
Services are provided on an “as available” basis. To the maximum extent permitted by law, BOOQDAT disclaims implied warranties and limits liability for indirect or consequential damages arising from platform use.
9. Governing law
These Terms are governed by the laws of the State of New Mexico, without regard to conflict-of-law rules.
10. Local compliance notice (Albuquerque / New Mexico)
Event promoters are responsible for compliance with applicable Albuquerque and New Mexico venue, occupancy, permitting, alcohol, and consumer-protection requirements. BOOQDAT may request additional documentation for high-capacity or regulated events.
